How do we maintain the safety of children when the mother allows the man to hit her at her home?

The answer, apparently, is: we do not.

This is the ruling this month from a committee of four judges from the Appeals Department in New York State.

We cannot ask infants and young children to apply protection orders against men who threaten their mothers. It is not surprising, there is a great connection between intimate partner's violence and child abuse.

But even if we assume that the man who beats his girlfriend will not put a finger on her children, what will happen to the infant if the mother comes out or worse?

The USA Today report was martyred with a woman whose baby and his little girl were removed to enhance care after her former boyfriend (who was in regular contact) by beating her unconscious in front of the children.

Can we agree at least that children who have to see men beat their mothers have no meaning with a level of shocks that should not be tolerated?

This may not seem fair, but we have to bear the responsible mother in some way about this situation.

If we do not want to sue her to leave her children in dangerous situations, and we do not want to remove children from her custody even though they may be in danger, sending someone from ACS to monitor the situation seems the least we can do.

Tom Rolling, the former head of the Georgia Division of Family and Children, tells me that New York has made itself out of this ruling.

“Most of the legal literature says that the subordinate hearings should be about the needs of the child, not the parents' needs,” said Rolling.

He said: “If you have a child who was abused, this gives the court's jurisdiction,” even if the guardian father is not the person who participates in violent behavior.

The Court of Appeal means that we will now ignore children trapped in these dangerous situations – or we start accusing mothers of neglect if they allow abusive men near their children in violation of protection orders.

Not perfect, but the safety of children should come first.

“I am very happy because other families will not have to pass what my family did,” said Western Work after the court ruling.

Unfortunately, thanks to this ruling, other families may have to pass much worse.
