A lawsuit filed by YouTuber Gabe Petito's family against the Utah State Police Force has been dismissed by a judge.

but, Utah 7th District Court Judge Don Torgerson It granted the city of Moab's request to drop the lawsuit and referred it to a higher court.

Now, the appeals court must review the case to determine whether the Petito family can make a convincing case.

In a statement to the US Sun, lawyers representing Petitos said they were surprised by the ruling.

“Although today’s ruling may seem like a setback, it was not unexpected,” Parker and McConkey said.

“We never expected this to be an easy process and look forward to the Utah Supreme Court upholding the original intent of the Utah Constitution of preserving the right to recover wrongful death claims under these circumstances.”

“We are committed to seeking justice for Gabe and thank the many people who have continued to support us in this fight.”
