The only woman in the execution row in Oklahoma could have disrupted a lighter penalty after thonga was offered in court by prosecutors “sex”.
Black Widow Brenda Andrew, 61, has been behind bars nearly 20 years ago since her husband died as part of a million dollar insurance fraud in 2001.
Now, her penalty can be changed because her lawyers claim that she was harsh in court.
The prosecutor Thongha carried the jury to show the type of underwear that Brenda wore and described it as a “rude puppy”.
The evidence also included the opinion of the witness that Brenda wore “clothes” and “provocative” that showed “a lot of division.”
The jury also heard details of the places and times that it was flirting with with men and other testimonies about its affairs – including some seventeen years before the crime.
Brenda's lawyers claim that the claim that she is, a Sunday school teacher who does not have a former criminal record, was “sexual shame”, so the jury will give her the harshest possible sentence.
Last week, the Supreme Court voted 7-2 in favor of Brenda's appeal, and the minimum court ordered a review of its conviction.
The Supreme Court statement wrote: “The prosecution raised a testimony about Andrew's sexual partners who have reached two decades about the clothes she was wearing for dinner or while the grocery was running around the underwear that was packed to spend a vacation; and about the number of times she had sex in her car .
“The ultimate question is whether the fair legal can be different that the evidence” was injured in the trial “to provide the resulting condemnation or the sentence” denial of legal procedures. “
Brenda was sentenced to death in 2004, along with her boyfriend and partner James Bavat, who is also a teacher at Sunday School, for her husband Rob Andrew.
When Rob returned to the family home to pick up his son and daughter on Thanksgiving on November 20, 2001, Brenda told him that a experimental light was in the oven.
Then he was shot twice, first by James, then Brenda, with his 16th gun, as the prosecutors claimed.
James has always denied that Brenda had participated in the deadly shooting of her husband.
He claims that after selling a $ 800,000 life insurance policy, he killed him with the help of another friend.
Brenda was shot in his arm during the killing, and the police said that two armed men carried out it.
The court's files state that Brenda is inappropriate during the trial that it saw that it is called a “spoiling puppy” by the prosecutors and published “a clear sexual history that is clearly related.”
The New York Times reported that Thong Brenda, in particular, was used as a smoking pistol in the case.
The Prosecutor said in 2004: “The sad widow can be defeated [her thong] To escape with her boyfriend.
“The facts cannot be distorted, and the people cannot be distorted.”
Brenda is said to have mastered the thong to travel with Bravat to Mexico after days of killing, where they lived for three months until the money was run out.
The couple was arrested when they tried to return to the United States in February 2002.
The Supreme Court ruling does not mean that Brenda will be released.
Instead, the case will return to the lower court, which must reconsider its ruling that the trial of Brenda was fair, given the ruling of the Supreme Court.
If the judges decide to trial in reality, it is not fair, the trial can be arranged or re -submitted.
Brenda's lawyer, Jessica Soton, said she hoped to “stop the Court of Appeal” this injustice. ”
She added: “The use of these sexes to justify the condemnation and punishment of death is unbearable and pose a threat to everyone who does not follow solid sexual standards.”
